1. Acceptance of Terms
By accessing or using Trending.com Studio ("Trending.com," "Service," "Platform," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
If you use the Service on behalf of a company, team, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Description of the Service
Trending.com Studio provides AI-assisted tools to help users create short-form videos and related assets, including scripts, captions, voice, images, motion, metadata, previews, and rendered outputs.
The Service may include one-click tools, manual workflows, dashboard features, APIs, MCP integrations, team features, and integrations with third-party providers.
3. Eligibility
To use the Service, you must:
- Be at least 18 years old, or the age of majority where you live
- Have legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
- Provide accurate, current, and complete account information
We may refuse access or close accounts that do not meet these requirements.
4. Accounts, Credentials, and Access
4.1 Account setup
You may need an account to use some or all of the Service. You agree to keep your registration information accurate and up to date.
4.2 Account responsibility
You are responsible for all activity under your account, including activity by anyone who gains access through your credentials, devices, API keys, or team access.
You agree to:
- Keep your password, login credentials, and API keys secure
- Notify us promptly if you believe your account has been compromised
- Not share credentials in a way that defeats plan limits, access controls, or security controls
- Not create or use accounts for another person without authorization
We may suspend, restrict, or terminate accounts that create security, billing, fraud, or abuse risk.
5. Credits, Payments, and Refunds
5.1 Credit-based usage
The Service may use subscriptions, credits, usage-based charges, or a combination of these models. Credits may be required for AI processing, rendering, storage, or related features.
5.2 Credits are generally non-refundable
Except where required by law, credits, subscription fees, and other charges for digital services are non-refundable once purchased, added to your account, or used.
This includes:
- Credits used for AI processing or video creation
- Credits used for rendering or related generation steps
- Unused credits remaining in your account
- Charges for outputs that did not meet your subjective expectations
- Charges connected to suspended, blocked, or removed abusive content
5.3 Pricing changes
We may update pricing, plans, or usage rules at any time. Changes will not retroactively change completed purchases unless required by law.
6. User Content, Inputs, and Permissions
6.1 Your content
"User Content" means anything you upload, submit, generate, store, or send through the Service, including prompts, scripts, audio, images, video, titles, captions, metadata, and final outputs.
6.2 Your warranties and permissions
You represent and warrant that you have all rights, permissions, licenses, notices, and consents needed to use your User Content and to authorize us and our providers to process it as part of the Service.
This includes, where applicable:
- Copyright, trademark, publicity, privacy, and contract rights
- Rights to music, footage, artwork, logos, and brand assets
- Rights to use any name, image, likeness, face, voice, signature, or persona appearing in the content
- Written consent or release from identifiable people appearing in or referenced by the content when required
- Consent and legal authority to upload any voice, facial, or other sensitive or biometric-related content you submit
You also represent and warrant that your User Content and your use of the Service do not violate law, platform rules, third-party rights, or these Terms.
6.3 License to Trending.com
You retain ownership of your User Content, subject to the rights of third parties and these Terms.
By using the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, transmit, display, modify, create technical derivative works from, and otherwise use User Content as needed to provide, maintain, secure, troubleshoot, improve, and support the Service.
6.4 Responsibility for review and release
You are solely responsible for:
- The legality and safety of your User Content
- Reviewing outputs before publishing or sharing them
- Obtaining any needed releases, disclosures, and permissions
- Keeping records of the permissions and releases you rely on
We do not endorse User Content and are not responsible for how you use or distribute it.
7. User Videos and Output Rights
7.1 Output ownership
Subject to third-party rights, these Terms, and any plan restrictions, you retain ownership of the output you generate using the Service.
7.2 Private by default
Studio renders are intended for the account that created them. We do not publish your Studio videos to public social networks or public galleries without your permission.
7.3 Your responsibility after creation
You may publish, distribute, or monetize your videos if you have the rights needed to do so, but you are responsible for how you use them and for complying with applicable law, platform rules, and third-party rights.
7.4 Our retained copies
We may retain copies of prompts, uploads, previews, outputs, and related records for quality assurance, customer support, abuse review, security, billing, disputes, legal compliance, backup recovery, and service records.
8. Prohibited Content and Conduct
8.1 Prohibited content
You may not upload, generate, request, publish, or distribute content that includes or promotes:
- Pornography, explicit sexual content, sexual services, fetish content, or nudity intended for sexual gratification
- Any sexual content involving minors, sexualization of minors, child sexual abuse material, grooming, or exploitative child content
- Non-consensual intimate imagery, revenge porn, hidden-camera sexual content, or sexual extortion
- Graphic violence, gore, torture, or violent cruelty
- Self-harm, suicide encouragement, eating-disorder promotion, or instructions for serious physical harm
- Hate speech, dehumanization, harassment, bullying, stalking, threats, or targeted abuse
- Terrorism, violent extremism, or instructions for violent wrongdoing
- Fraud, scams, phishing, impersonation, identity theft, or deceptive commercial practices
- Deceptive deepfakes or impersonation of real people, public figures, brands, or organizations without authorization or lawful basis
- Election misinformation, voter suppression, or deceptive political or civic process content
- Doxxing, private personal information, confidential information, or illegal surveillance material
- Malware, malicious code, or instructions to compromise systems
- Copyright, trademark, publicity, privacy, or other rights infringement
- Any other unlawful, harmful, abusive, or exploitative content
8.2 Prohibited conduct
You may not:
- Use the Service for any illegal purpose
- Attempt to bypass safety systems, moderation rules, plan limits, rate limits, or account restrictions
- Probe, overload, scrape, stress test, or interfere with the Service without authorization
- Create multiple accounts to evade suspension, pricing, safety rules, or access limits
- Resell, sublicense, or provide access to the Service without authorization
- Use the Service to create deceptive spam, mass abuse, or coordinated manipulation
- Use outputs in a way that falsely suggests real events, endorsements, or identity when disclosure is required
8.3 Trust and safety enforcement
We may use automated tools, provider tools, and human review to detect and investigate abuse, fraud, infringement, or safety concerns.
We may, at our sole discretion and without refund:
- Refuse prompts, uploads, or render requests
- Remove, block, or disable content
- Suspend, restrict, or terminate accounts, teams, or API access
- Cancel renders, withhold or reverse promotional credits, or limit features
- Preserve and disclose relevant information when we believe it is necessary to investigate or address abuse, infringement, child safety concerns, fraud, threats, or legal violations
Where we believe appropriate or are required to do so, we may report content or activity to service providers, payment providers, hosting or storage providers, child safety organizations, rights holders, or law enforcement.
9. AI Outputs and User Review
9.1 Nature of AI-assisted outputs
The Service uses artificial intelligence and other automated tools. You understand that AI systems can produce inaccurate, incomplete, biased, offensive, or unexpected results.
9.2 No guarantee of results
We do not guarantee that any output will:
- Meet your expectations or requirements
- Be accurate, complete, original, non-infringing, or fit for your intended use
- Comply with the rules of TikTok, YouTube, Instagram, or any other platform
- Avoid resemblance to existing works, people, voices, or styles
9.3 Human review is required
You are responsible for reviewing all outputs before use, publication, distribution, or reliance. Do not rely on the Service as your only review step for legal, factual, safety, brand, or rights-sensitive content.
9.4 Synthetic media and disclosure
You are responsible for making any AI-generated, synthetic-media, sponsorship, or other disclosures required by law, platform rules, contracts, or industry guidance.
10. Intellectual Property and Complaints
10.1 Platform ownership
The Service, including our software, site design, trademarks, branding, and underlying technology, belongs to Trending.com or its licensors and is protected by law.
10.2 Infringement complaints
If you believe content on the Service infringes your rights, send your complaint to [email protected] or use our contact page with enough detail for us to identify the material, understand your claim, and reach you.
Please include, where applicable:
- Your name and contact information
- A description of the work or rights you believe are affected
- A description of the allegedly infringing material and where it appears
- A statement of the basis for your complaint
- Any information reasonably needed for us to review the issue
We may remove or disable access to challenged content while we review a complaint, and we may terminate repeat infringers or repeated abusers.
10.3 Restrictions
You may not copy, sell, lease, sublicense, reverse engineer, or attempt to extract source code or non-public parts of the Service except as allowed by law or with our written permission.
11. Third-Party Services
The Service depends on third-party providers, including AI, hosting, storage, communications, and payment providers. We are not responsible for third-party services, their downtime, or their separate terms and policies.
Your use of third-party platforms where you publish content is governed by those third parties, not by us.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, OR ACCURACY.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDING.COM, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14. Indemnification
You agree to defend, indemnify, and hold harmless Trending.com, Inc. and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against claims, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your User Content
- Your outputs and how you use, publish, or distribute them
- Your violation of these Terms
- Your violation of law or third-party rights
- Your misuse of the Service
15. Suspension, Termination, and Effect of Termination
15.1 Termination by you
You may stop using the Service at any time. You may also request account closure through support or account settings where available.
15.2 Suspension or termination by us
We may suspend, restrict, or terminate access immediately, with or without notice, for reasons including:
- Violation of these Terms
- Suspected abuse, fraud, or illegal activity
- Safety, child-protection, or infringement concerns
- Security risk or unauthorized access
- Non-payment or chargeback risk
15.3 Effect of termination
If your account is suspended or terminated:
- Your right to use the Service stops immediately
- Unused credits may be forfeited and are generally non-refundable
- We may preserve relevant records, logs, prompts, uploads, outputs, billing records, and other data as needed for legal compliance, security, fraud prevention, abuse investigation, rights enforcement, quality assurance, or service integrity
- Provisions that should survive by their nature will survive
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version and change the "Last Updated" date above. If we make a material change, we may also provide additional notice where appropriate. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of Wisconsin, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts serving Jefferson County, Wisconsin, and each party consents to that venue and personal jurisdiction.
To the extent permitted by law, disputes must be brought on an individual basis and not as a class, consolidated, collective, or representative action.
18. General Provisions
These Terms are the entire agreement between you and us regarding the Service and replace prior understandings on that subject.
If any provision is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of our right to do so later.
You may not assign these Terms without our prior written consent. We may assign these Terms without restriction as part of a merger, acquisition, reorganization, or sale of assets.

20. Acknowledgment
By using Trending.com Studio, you acknowledge that you have read, understood, and agree to these Terms of Service.
