Politico Magazine writer Ankush Khardori appeared on MSNBC, voicing criticism towards President Joe Biden for not taking steps towards addressing the Supreme Court's balance and its recent controversial rulings. The panel, which included host Symone Sanders Townsend, a former Biden White House staffer, echoed the sentiment, suggesting that Biden should have considered reforming the highest court in the land.

The Supreme Court's deliberation on former President Trump's claim of absolute immunity, in relation to Special Counsel Jack Smith’s election interference investigation, has only intensified these discussions. MSNBC's Alicia Menendez pointed out that a staggering 70% of Americans reject the notion of presidential absolute immunity, as per a recent poll. Menendez, along with other panelists, proposed that court reform or even expanding the Supreme Court, known as court packing, might be necessary to bring about structural changes.

Khardori went as far as calling Biden’s inaction on court reform a "historic political miscalculation," especially at a time when the Supreme Court has made several controversial rulings, such as overturning Roe v. Wade, striking down affirmative action in higher education, legalizing discrimination against same-sex couples, and dismantling part of the Biden administration's policy on student loan forgiveness.

President Biden, who spoke at a campaign event on April 18, 2024, at the Martin Luther King Recreation Center in Philadelphia, has been criticized by the MSNBC panel from a progressive standpoint for not adopting more aggressive measures toward the Supreme Court. Symone Sanders Townsend reiterated that President Biden does not support court packing, a stance that may not sit well with the progressive wing of his party.

As the Supreme Court is anticipated to issue a ruling on presidential immunity by late June 2024, former President Trump has warned that a loss of his presidential immunity could set a harmful precedent for future presidents, including Biden. Trump's criminal trial is currently on hold as the Supreme Court weighs on this critical issue. Trump's legal team has argued that prosecuting a former President could lead to damaging cycles of political retribution.

The refusal to consider expanding the court is a clear surrender to the conservative agenda, leaving Americans at the mercy of a court that's out of touch with the will of the people. It's a dark time when even the president won't stand up to the authoritarian impulses of a court that's become a rubber stamp for the far-right.
