Arbitration is an abuse to begin with, but that sure is a bad faith interpretation of an arbitration clause if I've ever seen one, especially since Disney+ presumably isn't what killed her.

This argument was stupid, but this is also a weird lawsuit. This was at Disney Springs Mall, Disney is just the landlord, another company runs the restaurant. It's the company that runs the restaurant that should be sued. I suspect the lawyer was just hoping for a quick settlement from Disney. They will most likely lose in court unfortunately.

I mean, the arbitration thing is weird but its hardly evil: she didn't die at a park, she died at disney springs, a shopping mall of independently owned and operated stores and restaurants. Disney got sued because its a legal formality to sue a restaurant and the mall to get each other to narc, but Disney didn't prepare the food, hire the negligent waiter, or serve it. The restaurant is being sued too and I'm guessing are the proper ones to pay out here.
