Raskin, the ranking member of the House Oversight Committee, cites the potential bias linked to Thomas's wife, Ginni Thomas, and her involvement with the "Stop the Steal" rally that supported the false claim that Trump won the 2020 election.

The controversy around Trump’s eligibility stems from decisions in Colorado and Maine, where state officials have declared Trump ineligible for their 2024 primary ballots. This decision is grounded in the Constitution's insurrection clause, specifically Section 3 of the 14th Amendment, which disqualifies individuals from holding public office if they have engaged in insurrection after taking an oath to support the Constitution.

Conservative legal scholars have joined the fray by suggesting in a law review article that Trump’s involvement in the Capitol riot constitutes insurrection, thereby disqualifying him from being on the ballot.
