Judge Issues Gag Order on Trump in Hush-Money Trial

Former President Donald Trump is now under a partial gag order, as mandated by New York State Judge Juan Merchan, relating to his upcoming hush-money criminal trial. The gag order explicitly prohibits Trump from making public remarks about a wide array of trial participants including witnesses, prosecutors, court staff, jurors, and their families. However, Trump retains the ability to comment on Judge Merchan and Manhattan District Attorney Alvin Bragg, who is prosecuting the high-profile case.

The order arrives ahead of the trial's commencement on April 15, which was postponed from its original March 25 date due to the emergence of new evidence regarding Trump's connections with Russia. The case centers on allegations that Trump violated New York campaign finance and tax laws by authorizing a $130,000 payment to adult film actress Stormy Daniels in 2016. The legality of the reimbursement payments to Trump's former attorney, Michael Cohen, for the hush money will be scrutinized.

Despite the restrictions, Trump has been vocal against Judge Merchan, accusing him of bias in a social media post and calling him a "true and certified Trump Hater" suffering from "Trump Derangement Syndrome." This is partly due to Merchan's daughter working for a firm with Democratic clients such as Joe Biden. Merchan characterized Trump's previous statements as "threatening" and "inflammatory," prompting the gag order's implementation.

Trump's campaign spokesman Steven Cheung has labeled the gag order as an attack on Trump's First Amendment rights. Moreover, Trump's legal team argued that his communication with the public is essential given his status as the presumptive Republican nominee for president, but the judge dismissed this claim.

The gag order was established following Trump's criticisms on Truth Social, where he lambasted the judge, his daughter, Bragg, and Cohen, with Cohen publicly expressing gratitude for the order. Additionally, Judge Arthur Engoron also mandated that Trump and his attorneys refrain from discussing his law clerk or other court personnel after allegations of bias led to threats. A similar directive had been issued in October in a federal election interference case, which was later modified by an appeals court.

The Supreme Court is presently contemplating Trump's defense of presidential immunity in the federal case. Meanwhile, the Manhattan district attorney's office sought the partial gag order, citing Trump's history of incendiary remarks about judicial participants. Judge Merchan has also rejected Trump's attempts to alter the pretrial motion filing process and has demanded permission for any additional motions.

Further complicating matters, a New York appeals court required Trump to pay a $175 million bond related to his civil fraud trial, a reduction from the original $464 million amount. Attorney General Letitia James had been in the process of seizing Trump's assets to secure the full bond before the reduction. Trump's attorneys claimed the original amount was prohibitive, indicating that 30 lenders had denied them a loan to cover it.

With the hush-money trial's previous delay due to evidence pertaining to Trump's Russian ties, Trump's lawyers had pushed to dismiss or postpone the case for additional time to review newly disclosed documents. However, Judge Merchan ruled that these documents did not impact the hush-money case.

As the Manhattan prosecutors have been pursuing a gag order on Trump since mid-February, Trump has conveyed his belief that "tens of millions of Americans" are eager to hear his side in a case he perceives as politically motivated. Judge Merchan, on his part, has emphasized that a defendant's freedom of speech should be constrained only to the extent necessary to maintain the integrity of the trial.
