Education Secretary Cardona Calls for Increased Civil Rights Funding

Education Secretary Miguel Cardona has taken a firm stance against violent school demonstrations and the rise in campus antisemitism, advocating for legislative support to boost civil rights funding. In a recent appeal, Cardona urged lawmakers to allocate an additional $22 million to the Education Department's civil rights arm, pushing the total requested budget to $162 million.

The proposed budget increase is primarily aimed at funding investigations into the growing number of Title VI complaints, which address discrimination based on race, color, or national origin, including acts of antisemitism. Secretary Cardona underscored that ninety percent of the boosted Office for Civil Rights (OCR) budget would facilitate hiring additional staff, thereby allowing for more effective management of caseloads.

Despite Cardona's proactive approach, House Education and the Workforce Committee Chair Virginia Foxx (R-N.C.) has criticized the Secretary's handling of campus unrest and has called for his resignation. Nevertheless, Cardona's appearance at the budget hearing was focused on securing support for the Education Department's financial plan, rather than indulging in political theatrics.

Among Cardona's advocates are Representatives Mark Takano (D-Calif.), Kathy Manning (D-N.C.), and Jahana Hayes (D-Conn.), who support the call for increased resources for the department’s civil rights division. Cardona reported that the OCR has successfully closed two antisemitism cases and is currently handling over 100 open investigations into ancestry-based discrimination under Title VI. The proposed OCR budget hike would enable the employment of investigators dedicated to these cases.

Reiterating the gravity of these issues, Secretary Cardona stated that colleges could face the loss of federal funding if found in violation of Title VI, emphasizing the necessity of ensuring safe and nondiscriminatory environments for all students. In addition, the Department of Education is set to expand Title IX rules to include discrimination protections for pregnant, transgender, or nonbinary students. However, at least five Republican state officials have advised school districts to disregard these new regulations.

Addressing technical issues that troubled the December 2023 launch of the Free Application for Federal Student Aid (FAFSA), Secretary Cardona offered an apology and pledged to implement measures to prevent future occurrences. Moreover, the Educational Credit Management Corporation has been assigned the responsibility of managing up to $50 million in grants to support organizations that aid college access and enrollment, underscoring an ongoing commitment to educational equity and support.
