Biden Proposes Major Supreme Court Reforms

In a historic move, U.S. President Joe Biden will propose sweeping reforms to the Supreme Court, including term limits and a binding code of conduct for its nine justices, during a speech at the presidential library of former President Lyndon B. Johnson in Austin, Texas. Emphasizing that no one is above the law, Biden outlined his vision in an op-ed published in the Washington Post. The proposed changes come a week after Biden ended his reelection bid and endorsed Vice President Kamala Harris, who is set to face Republican presidential candidate Donald Trump in November.
Biden will also call for a constitutional amendment to eliminate broad presidential immunity from federal criminal indictment, trial, conviction, or sentencing. This amendment, named the "No One Is Above the Law Amendment," aims to strip the president of immunity for crimes committed while in office. The proposal follows a Supreme Court decision granting presidents full immunity for some actions taken while in office—a landmark ruling that has sparked widespread debate.
Enacting such a constitutional amendment requires two-thirds support from both chambers of Congress or a convention called by two-thirds of the states, followed by ratification by 38 of the 50 state legislatures. Given the deeply-divided Congress, Biden's proposed changes face significant legislative hurdles. Critics argue that the current code of conduct for Supreme Court justices is insufficient as it allows justices to decide on their own recusal and lacks enforcement mechanisms.
Biden's push for reforms also addresses public discontent with the Supreme Court, particularly its controversial decisions on abortion, immigration, student loans, vaccine mandates, and climate change. A Marquette Law School poll in May found that 61% of Americans disapprove of the job the Supreme Court is doing. Biden's proposed reforms include enforceable rules requiring Supreme Court justices to disclose gifts, avoid public political activity, and recuse themselves in cases with financial or other conflicts of interest. He will also urge Congress to adopt an 18-year term limit for Supreme Court justices.
Vice President Kamala Harris and Biden have made abortion rights a central part of their campaign arguments, leveraging public disapproval of the Supreme Court's 2022 ruling overturning Roe v. Wade to drive voters. The proposed changes are intended to restore trust and accountability in both the presidency and the Supreme Court. However, legislative approval remains a significant challenge, as Republicans control the House and Democrats have a slim Senate majority.
Biden's speech at the LBJ presidential library will coincide with an event commemorating the Civil Rights Act, underscoring the historical significance of his proposals.
